Why you need terms and conditions

Unlike a privacy policy, terms and conditions usually aren't required by law. They are still one of the most useful documents you can publish, because they are your contract with users. Clear terms let you limit your liability, set the rules for acceptable use, explain renewals and refunds, and give you a documented reason to suspend accounts that abuse your service.

How to customize this template

  1. Fill in your details. Company name, product name, contact email, and the state or country whose law applies.
  2. Match the billing section to your plans. Say how often you bill, how cancellation works and whether you offer trials. If you sell subscriptions to consumers, check the automatic renewal rules where your customers live.
  3. Adjust the minimum age. Use the age your product is actually designed for, and make sure it matches your privacy policy.
  4. Review liability and disputes. These clauses matter most if something goes wrong. If you want arbitration or a class action waiver, talk to a lawyer about the rules where your users live.
  5. Make users agree. Add a checkbox or clear statement at sign-up that links to the terms, so there's a record that people accepted them.

What is the difference between terms of service and terms and conditions?

There isn't one in practice. Terms of service, terms and conditions and terms of use are different names for the same kind of agreement between you and your users.

Are terms and conditions legally required?

Generally no, but some of their contents can be. For example, subscription businesses often have to disclose renewal and cancellation terms clearly, and online stores have to explain consumer rights such as refunds.

How do I make my terms enforceable?

Show users the terms before they sign up and ask them to actively agree, for example with a checkbox next to a link. Terms that are only linked in a footer, with no clear acceptance, are harder to enforce.

Can I use the same terms for my website and my app?

Yes, if they are the same service. Host the terms on one public URL and link to it from both, so you only have one version to keep up to date.
